Terms of service
Last updated: 25/03/2026
These Terms & Conditions (“Terms”) explain how you may access and use our online marketplace and the services we provide. By using our website, creating an account, or placing an order, you agree to these Terms.
1. About Us
Memorabilia Seller Ltd (“we”, “us”, “our”) operates an online marketplace where independent vendors list and sell memorabilia and related products.
Business Name: Memorabilia Seller Ltd Registered Address: Eastwood Farm, Shaves Wood Lane, Albourne, Hassocks, BN6 9DY Contact Email: sales@memorabiliaseller.com
We provide the platform that connects buyers and vendors. Unless stated otherwise, we are not the seller of the items listed on the marketplace.
2. Our Role as a Marketplace
Our platform allows independent vendors to create listings, sell products, and fulfil orders. When you purchase an item:
You enter into a contract with the vendor, not with us.
The vendor is responsible for product descriptions, pricing, fulfilment, and returns (unless we state that we fulfil on their behalf).
We act as the facilitator of the transaction and may assist with customer service and dispute resolution.
3. Creating an Account
To use certain features, you may need to create an account. You agree to:
Provide accurate and up‑to‑date information
Keep your login details secure
Notify us immediately of any unauthorised access
We may suspend or close accounts that breach these Terms or are used fraudulently.
4. Product Listings and Descriptions
Vendors are responsible for ensuring that:
Product descriptions are accurate
Images represent the item fairly
Any authenticity claims are truthful and supported by evidence
We do not guarantee the accuracy of vendor listings but take reasonable steps to monitor compliance.
5. Authenticity of Memorabilia
Authenticity is important in the memorabilia industry. Vendors must comply with our authenticity standards, which may include:
Certificates of authenticity
Proof of provenance
Tamper‑proof holograms or seals
If an item is found to be counterfeit, we may:
Remove the listing
Suspend or terminate the vendor’s account
Assist you in obtaining a refund
6. Ordering and Payment
When you place an order:
You agree to pay the listed price, including taxes and shipping
Payment is processed securely through our payment partners
The vendor receives your order details to fulfil your purchase
We reserve the right to cancel or refuse orders where necessary (e.g., suspected fraud, pricing errors).
7. Delivery and Fulfilment
Delivery times and shipping methods vary by vendor. Each vendor is responsible for:
Dispatching your order
Providing tracking information where available
Meeting estimated delivery times
If your item is delayed, damaged, or lost in transit, the vendor is responsible for resolving the issue.
8. Returns, Refunds, and Cancellations
Your rights depend on the type of item purchased and the vendor’s policy.
Vendors must comply with UK consumer law unless an exemption applies (e.g., bespoke or personalised items).
Some memorabilia items may be exempt from returns if tamper‑proof seals are broken.
Refunds are issued by the vendor unless we state otherwise.
Full details are available in our Returns & Refunds Policy.
9. Marketplace Fees
You do not pay fees to browse or purchase items. Vendors may pay fees or commissions to use the platform. These do not affect the price you pay as a customer.
10. Prohibited Use
You must not:
Use the site for unlawful purposes
Attempt to interfere with the platform’s security
Harass vendors or other users
Upload harmful or misleading content
We may suspend or terminate accounts that breach these rules.
11. Intellectual Property
All content on the website—including text, images, branding, and design—is owned by us or our licensors. You may not copy, reproduce, or use it without permission.
Vendor‑uploaded content remains the property of the vendor, who grants us a licence to display it on the marketplace.
12. Our Liability
Because we are a marketplace:
We are not responsible for the quality, safety, or legality of items sold by vendors
We are not liable for losses caused by vendor actions or omissions
We do not guarantee that the website will be error‑free or uninterrupted
Nothing in these Terms limits your statutory rights.
13. Dispute Resolution
If you have an issue with an order:
Contact the vendor directly using the details provided
If the issue is not resolved, contact us and we will help mediate
If necessary, you may escalate the matter through your payment provider or the relevant consumer protection body
14. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on our website. Continued use of the marketplace means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
